This Privacy Policy describes how DineAtMine Ltd.. and its affiliates (“we,” “us,” or “DineAtMine”), process personal information in relation to your use of the DineAtMine Platform. Depending on where you live and what you are doing on the DineAtMine Platform, the supplemental privacy pages listed below may apply to you. Please follow the links and review the supplemental information describing how we process personal information for those regions and services.

1.    Overview

 

Privacy Policy (hereinafter referred to as the "Policy") applies to information that either allows or does not allow the user to be identified (including personal data) in the applicable law (hereinafter referred to as "Personal Information"), which DineAtMine Ltd. (hereinafter referred to as "Our Company") can receive about you when you use any programs and / or websites of Our Company (hereinafter referred to as the "Service"), as well as when Our Company performs the agreements and contracts signed by you, needed to use Our Service.

 

You provide our Company with your personal data and give a full and unconditional consent for its processing, including cross-border transfer, solely under the following privacy policy.

 

We can also transfer and receive your personal data from our partners (hereinafter referred to as "Partners"), programs, websites, service or services which are used (for example, from our advertisers). The transfer of Personal Data is possible only in cases established by the applicable law, and is carried out by virtue of the contracts between us and each of the partners.

The responsibility for all the activities related to the processing of personal Data during the

use of the company service is held by DineAtMine Ltd., a legal entity created under the

laws of the United Kingdom and registered in London, 71-75 Shelton Street,Covent

The protection of your personal data and your privacy is extremely important for our Company. Therefore, when you use the Service of our company, we protect and process the Personal Data received from you in strict compliance with applicable laws.

 

4.    What information does DineAtMine collect from you?

We collect information from and about users of our Website:

  • Directly from you when you provide it to us.

  • Automatically when you use the Website.

 

2.2 We do not collect special categories of personal data such as information relating to or about the below or information about criminal records.

  • Health

  • Racial or ethnic origin

  • Political opinions

  • Membership of a political association

  • Membership of a trade union

  • Religious beliefs or affiliations

  • Philosophical beliefs

  • Sexual orientation or practices

  • Biometric information

2.3 Information that you provide to us (“personal information”) when you register or join a group on our website may include:

  • First Name, Last Name;

  • Location;

  • Date of Birth;

  • Email Address;

  • Telephone number; and

  • Banking information, credit card, and debit card number

  • Location data: Some of the DineAtMine Ltd website features may access and collect your location data, including GPS coordinates or other similar information regarding the location of your device. Some features of DineAtMine Ltd may not function properly if use of location data is blocked or disabled

 

This information may be collected as a result of you creating an account to join our website. 

2.4 This information may also include:

  • Information that you provide by filling in your register on the Website such as first name, last name, email address, telephone number and address (“Contact Information”). This includes information provided at the time of registering to use the Website and requesting further services.

  • Information you provide to us when you complete user surveys or surveys for research purposes such as your Contact Information.

  • Information you provide to us when you report a problem with the Website such as your first name, last name and email address.

  • Records and copies of your correspondence (including e-mail addresses and phone numbers), if you contact us.

  • Details of transactions you carry out through the Website when you make payment to Cloutr.

  • Your correspondence within the Website with other users (your username and location).

 

5. What does DineAtMine use information collected for?

Any information collected by us is for a purpose in relation to your use of our website/app, including for providing the services, processing, and delivering your orders.

  1. Provide Services to you: We collect information to send you email or postal mail, perform tasks required to complete a transaction, provide customer support, or provide other types of customer relationship management and fulfillment. We may also use your information to optimize or improve our Services and operations, for example, training and quality assurance.

  2. Fulfilling legal and compliance obligations: We collect information to fulfill our legal obligations. Examples of this may include satisfying regulatory screening requirements in connection with entity formations, responding to subpoenas and other legal requests for information, and maintaining records as required in our role as Registered Agent. We may also collect information to detect fraud or other suspicious activity.

  3. Analytics: We collect information for use in performing various types of analytics. For example, we use the information to analyze how visitors interact with our website, where visitors to our website arrive from and exit to, pages visited, links clicked, text entered and mouse movements to understand site usage, to detect fraud and potential threats and improve our services.

  4. To communicate with you: We collect your email address and phone number to (i) contact you regarding your use of our website/app, (ii) respond to your questions, complaints, and queries, and (iii) send you updates regarding our services or this Policy and other agreements;

  5. For other purposes through your consent: We may also process your information for some other reasons which your consent will be sought before we process such information. You may also withdraw your consent at any time.

 

6.    WHO DO WE SHARE YOUR INFORMATION WITH?

1.     Service Providers: We may share personal information with agents, affiliates, partners, or other third parties that perform functions on our behalf, such as analytics, etc. These entities have access to the personal information needed to perform their functions and are obligated to maintain the confidentiality and security of that personal information. Service providers are not authorized to use the information we share with them for any purpose other than providing services to us or you.

2.     Required by Law: We may disclose information as required by law, such as in response to a subpoena, a lawful request by a public authority, including to meet national security or law enforcement requirements, or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a legal request.

While we do not disclose personal information to any companies not part of DineAtMine or its parent, subsidiaries or related entities, as discussed below, we may provide some personal information to certain service providers and other third parties, in no event will we sell your personal information as part of a customer list or similar transaction for unrelated parties to independently market to you.

 

7.    Legal basis and purposes of Personal Data processing

Our Company does not have the right to process your Personal Data without sufficient legal grounds. In this regard, we process your Personal Data only in the following cases:

 

·      when processing is necessary to fulfil our company's contractual obligations to you, including ensuring the operation of the Service;

 

·      when processing is necessary to comply with the obligations established by law;

·      when (provided by the applicable law) the processing is necessary to ensure the legitimate interests of our company in case if such processing does not have a significant impact on your interests, rights and freedoms.

 

·      improving, changing, personalising, or otherwise enhancing the Service for the benefit of all users, understanding how you interact with them;

 

·      offering you other service of our company or of other companies which, in our opinion, may be interesting to you (i.e. showing you advertising that takes into account your interests);

 

·      for specific purposes, we may request your special consent to the processing of your Personal Information.

 

·      giving you access to the Service;

·      providing access to your account (when it's needed for the Service usage);

·      contacting you to provide you with notifications, requests and information related to the operation of the Service, the implementation of agreements with you and the processing of your requests and applications;

 

·      facilitating the Service usage;

·      creating new Service;

·      protecting your rights and rights of Our Company;

·      collecting, processing and presenting statistics and other studies.

 

Attention. If you refuse to grant us the right to process personal data, we will not be able to guarantee the full functionality of some of our Service.

 

8.    Protection of Personal Data

Our company takes appropriate organisational and technical measures to protect personal information from unauthorised or accidental access to it, modification, loss or destruction. We constantly update the security measures, guided by the latest technological developments, as well as by applicable law.

9.    Third party access to Personal Data

 

Our Company can also transfer Personal Data to third parties, in order to implement the aims and objectives specified in this Policy. Such third parties may include:

  • (a)partners, such as website and application owners, advertising networks and other partners who provide us with services related to the placement and display of advertising on websites, programs, service or services owned or controlled by such partners;

  • (b)advertisers or other Partners who display advertisements for you in our Company’s Service, as well as such Partners as information or analytical service providers or

  • consultants.

 

·      third parties for whom has been made an assignment of rights or obligations under the relevant agreement;

 

·      any national and/or international regulator, law enforcement agencies, central or local executive authorities, other official or government authorities or courts which Our Company should provide with information according to the applicable law;

 

·      third parties, if you have agreed to the transfer of your Personal Data or the transfer of Personal Information is required to provide you with the relevant Service or to perform a specific agreement or contract entered into with you;

 

  • f) any third party in order to provide legal protection to Our Company or third parties if you violate the User Agreement of Our Company services, this Policy or the terms governing the use of certain Services, or in situations with such a violation.

 

10.Disclosures of information

We do not sell or disclose the personal information about you described above to nonaffiliated parties (including but not limited to companies, authorities, institutions, or individuals) except to provide you with products or services, when we have your permission, or under the circumstances listed below. We do not disclose your personal information to third parties for those third parties’ own marketing purposes.

•               With other users of our services in order to provide our Services, such as disclosing a child’s information with a parent, teacher, or school administrator so that the parent, teacher, or school administrator can monitor his/her child’s progress on our Services;

•               To nonaffiliated companies that we engage as contractors or agents to perform services for us, such as administering our Website, systems, and software; sending direct mail communications; or administering a sweepstakes or contest. We will disclose your information with such contractors only to the extent reasonably necessary for them to perform services on our behalf, consistent with this Privacy Policy;

•               In response to subpoenas, court orders, or legal process, from law enforcement agencies or state and federal regulators, or as otherwise required by law;

•               To assert or defend our legal rights, including fraud prevention and enforcing this Privacy Policy and our Terms of Use;

•               To protect the rights, property, or safety of us or other persons, including to detect, prevent, or otherwise address fraud, security, or technical issues, or anything else that we may consider to be, or pose a risk of being, an illegal, unethical, or legally actionable activity;

•               As we deem appropriate to attempt to prevent physical or emotional harm to other persons and/or to their property based on overt or implied threat;

•               Within our company with an actual or proposed corporate merger, acquisition, asset purchase, or other transaction or proceeding involving all or part of the business or assets to which the information pertains; and

•               To other companies, such as direct marketers to perform marketing services on our behalf, or other institutions with whom we have joint marketing agreements.

•               We may also disclose aggregate, anonymous, or de-identified information about users for marketing, advertising, research, compliance, or other purposes.

 

 

11. Personal Data Storage

Our Company has taken measures to transfer and store your personal data according to the applicable law and the rules of personal data protection.

 

 

12.The Personal Data storage period

Our Company will retain your Personal Data for the period necessary to fulfil the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law. After the expiration of that period, the corresponding data is routinely deleted, as long as it is no longer needed.

 

13.Your rights

You have the right to access your Personal Data which is processed by Our Company according to this Policy, if it is provided by the applicable law.

 

If you admit that any information, we store about you is incorrect or incomplete, you can correct and/or supplement your Personal Data (if it is provided by the Service) or contact us and request correction.

 

In addition, you have the right to:

·     require the partial or complete removal of your Personal Data;

·     require restrictions on your Personal Data processing;

·     take exception against your Personal Data processing.

Our company will comply with these requests under the applicable law.

In cases provided by applicable law, you can also have other rights, not specified above. Please note that most of the Personal Data about you that we hold can identify only a particular browser or device and cannot identify you. You will need to provide us with additional information so that we can identify your personal data that we hold, and to implement your request. 14.Accessing and correcting your information

You can review and change your personal information by logging into the Website and visiting your account profile page.

You may also send us an e-mail at terms@dineatmine.uk.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Website users. Proper access and use of information provided on the Website, including User Contributions, is governed by our terms and conditions.

15.Data security

We have implemented multiple security measures designed to secure your personal information from accidental loss and unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.

The safety and security of your information also depend on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

 

16. Updating this Policy

Our Company has the right to make changes to this Policy at its discretion. Therefore, we recommend you to periodically review this Policy.

You also can use our support e-mail to send requests on your personal data correction or complaints connected with illegality of its processing.

18. User Data Deletion

If you wish to no longer store your previously collected data with us in order to use our platform you can do this by going within the App to Profile/Settings/Delete Profile.

We generally retain your personal information for as long as is necessary for the performance of the contract between you and us, to comply with our legal obligations, and as permitted by applicable law.

You have the right to ask us to delete your personal information, subject to certain limitations and restrictions. Please note that if you request the erasure of your personal information:

We may retain your personal information as necessary for our legitimate business interests, such as prevention of money laundering, fraud detection, and prevention and enhancing safety. For example, if we suspend an DineAtMine account for fraud or safety reasons, we may retain information from that DineAtMine account to prevent that Member from opening a new DineAtMine account in the future.

We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, DineAtMine and DineAtMine Payments may keep your information for tax, legal reporting and auditing obligations. Information you have shared with others (e.g., Reviews, forum postings) will continue to be publicly visible on DineAtMine, even after your DineAtMine account is cancelled. However, attribution of such information to you will be removed. Some copies of your information (e.g., log records) will remain in our database, but are disassociated from personal identifiers.Because we maintain DineAtMine to protect from accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited period of time.

1. DEFINITIONS

Undefined terms in this Privacy Policy have the same definition as in our Terms of Service (“Terms”).

2. PERSONAL INFORMATION WE COLLECT

2.1 Information needed to use the DineAtMine Platform.

We collect personal information about you when you use the DineAtMine Platform. Without it, we may not be able to provide all services requested. This information includes:

  • Contact Information, Account, Profile Information. Such as your first name, last name, phone number, postal address, email address, date of birth, and profile photo, some of which will depend on the features you use.

  • Identity Verification and Payment Information. Such as images of your government issued ID (as permitted by applicable laws), your ID number or other verification information, bank account or payment account information. If you are not an DineAtMine user, we may receive payment information relating to you, such as when an DineAtMine user provides your payment card to complete a booking. If a copy of your ID is provided to us, we may scan, use, and store information contained in your ID to verify your identity.

2.2 Information you choose to give us.

You can choose to provide us with additional personal information. This information may include:

  • Additional Profile Information. Such as gender, preferred language(s), city, and personal description. Some of this information as indicated in your account settings is part of your public profile page and will be publicly visible.

  • Information About Others. Such as a payment instrument belonging to another person or information about a co-traveler. By providing us with personal information about others, you certify that you have permission to provide that information to DineAtMine for the purposes described in this Privacy Policy, have shared the DineAtMine Privacy Policy with them, and they have read and understood that it applies to them.

  • Address Book Contact Information. Address book contacts you import or enter manually.

  • Other Information. Such as when you fill in a form, add information to your account, respond to surveys, post to community forums, participate in promotions, communicate with our customer care team and other Members, or share your experience with us. This may include health information if you choose to share it with us.

2.3 Information Automatically Collected by Using the DineAtMine Platform and our Payment Services.

When you use the DineAtMine Platform and Payment Services, we automatically collect personal information. This information may include:

  • Geo-location Information. Such as precise or approximate location determined from your IP address or mobile device’s GPS depending on your device settings. We may also collect this information when you’re not using the app if you enable this through your settings or device permissions.

  • Usage Information. Such as the pages or content you view, searches for Listings, bookings you have made, and other actions on the DineAtMine Platform.

  • Log Data and Device Information. Such as details about how you’ve used the DineAtMine Platform (including if you clicked on links to third party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data, and the pages you’ve viewed or engaged with before or after using the DineAtMine Platform. We may collect this information even if you haven’t created an DineAtMine account or logged in.

  • Cookies and Similar Technologies as described in our Cookie Policy.

  • Payment Transaction Information. Such as payment instrument used, date and time, payment amount, payment instrument expiration date and billing postcode, PayPal email address, IBAN information, your address, and other related transaction details.

2.4 Personal Information We Collect from Third Parties.

We collect personal information from other sources, such as:

  • Third-Party Services. If you link, connect, or login to the DineAtMine Platform with a third party service (e.g. Google, Facebook, WeChat), you direct the service to send us information such as your registration, friends list, and profile information as controlled by that service or as authorized by you via your privacy settings at that service.

  • Background Information. For Members in the United States, to the extent permitted by applicable laws, we may obtain, for example, reports of criminal records, sex offender registrations, and other information about you and/or your background. For Members outside of the United States, to the extent permitted by applicable laws and with your consent where required, we may obtain the local version of police, background, or registered sex offender checks. We may use your information, including your full name and date of birth, to obtain such reports.

  • Enterprise Product Invitations and Account Management. Organizations that use our Enterprise products may submit personal information to facilitate account management and invitations to use enterprise products.

  • Referrals and co-travelers. If you are invited to the DineAtMine Platform, such as a co-traveler on a trip, the person who invited you can submit personal information about you such as your email address or other contact information.

  • Other Sources. To the extent permitted by applicable law, we may receive additional information about you, such as references, demographic data, or information to help detect fraud and safety issues from third party service providers and/or partners, and combine it with information we have about you. For example, we may receive background check results or fraud warnings from identity verification service providers for use in our fraud prevention and risk assessment efforts. We may receive information about you and your activities on and off the DineAtMine Platform, or about your experiences and interactions from our partners. We may receive health information, including but not limited to, health information related to contagious diseases.

3. HOW WE USE INFORMATION WE COLLECT

If you reside outside of the United States, read below to learn about our legal bases for collection and processing personal information. We use personal information as outlined in this Privacy Policy.

3.1 Provide, Improve, and Develop the DineAtMine Platform. Such as to:

  • enable you to access the DineAtMine Platform and make and receive payments,

  • enable you to communicate with other Members,

  • process your request,

  • perform analytics, debug and conduct research,

  • provide customer service, training,

  • send you messages, updates, security alerts, and account notifications,

  • if you provide us with your contacts’ information, such as your friends or co-travelers, we may process this information: (i) to facilitate your referral invitations, (ii) to share your trip details and facilitate trip planning, (iii) for fraud detection and prevention, and (iv) to facilitate your requests or for any other purpose you authorize,

  • personalize and customize your experience based on your interactions with the DineAtMine Platform, your search and booking history, your profile information and preferences, and other content you submit, and

  • enable your use of our enterprise products.

3.2 Create and Maintain a Trusted and Safer Environment. Including to:

  • detect and prevent fraud, spam, abuse, security and safety incidents, and other harmful activity,

  • study and combat discrimination consistent with our Nondiscrimination Policy,

  • conduct security investigations and risk assessments,

  • verify or authenticate information provided by you,

  • conduct checks against databases and other information sources, including background or police checks,

  • comply with our legal obligations, protect the health and well-being of our Guests, Chefs, Chefs’ employees, and members of the public,

  • resolve disputes with our Members, including sharing information with your co-Chef or additional Guests about disputes related to your role as a co-Chef or additional Guest,

  • enforce our agreements with third parties,

  • comply with law, respond to legal requests, prevent harm, and protect our rights (see section 4.5),

  • enforce our Terms and other policies (e.g. Nondiscrimination Policy), and

  • in connection with the activities above, we may conduct profiling based on your interactions with the DineAtMine Platform, your profile information and other content you submit to DineAtMine, and information obtained from third parties. In limited cases, automated processes, which analyze your account and activities on the DineAtMine platform as well as information in relation to activities on and off the DineAtMine platform that can be associated with you, could restrict or suspend access to the DineAtMine Platform if such processes detect activity that may pose a safety or other risk to DineAtMine, our community, or third parties. If you would like to challenge decisions based on automated processes, please contact us via the Contact Information section below.

3.3 Provide, Personalize, Measure, and Improve our Advertising and Marketing. For example to:

  • send you promotional messages, marketing, advertising, and other information based on your preferences and social media advertising through social media platforms,

  • personalize, measure, and improve our advertising,

  • administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by DineAtMine or its third-party partners,

  • analyze characteristics and preferences to send you promotional messages, marketing, advertising, and other information that we think might be of interest to you, and

  • invite you to events and relevant opportunities.

3.4 Provide Payment services. Personal information is used to enable, or authorize third parties to use, Payment Services such as to:

  • detect and prevent money laundering, fraud, abuse, and security incidents,

  • conduct security investigations and risk assessments,

  • comply with legal obligations (such as anti-money laundering regulations),

  • enforce the Payment Terms and other payment policies,

  • with your consent, send you promotional messages, marketing, advertising, and other information that may be of interest to you based on your preferences, and

  • provide and improve Payment Services.

4. SHARING & DISCLOSURE

If you reside outside of the United States, learn about safeguards we rely on for transferring personal information to recipients outside of the EEA below in section OUTSIDE THE UNITED STATES

4.1 Sharing With Your Consent or at Your Direction.

Where you provide consent, we share your information as described at the time of consent, such as when authorizing a third-party application or website to access your DineAtMine account or participating in promotional activities by DineAtMine partners or third parties.

Where permissible under applicable law, we may use certain information about you such as your email address, de-identify it, and share it with social media platforms to generate leads, drive traffic to DineAtMine, or otherwise promote our products and services.

4.2 Sharing Between Members.

To help facilitate bookings or other interactions between Members, we may need to share certain information such as:

  • When a booking request is made, when there is a co-Chef, or a dispute is submitted, certain information may be shared between Guest(s) and Chef(s), including profile, name, names of any additional Guests, cancellation history, review information, age of guest (unless prohibited by applicable law), dispute outcome (when applicable), and other information you choose to share and submit. When a booking is confirmed, additional information is shared to assist with coordinating the trip, like profile photo and phone number. When you as a Chef have a confirmed booking, certain information is shared with the Guest (and any additional Guests they invite, if applicable) to coordinate the booking, such as your profile, full name, phone number, and Listing address.

  • When you as a Chef invite another Member to Chef with you, you authorize that person to access and update your information and Member Content, including, but not limited to, certain information like your full name, phone number, Accommodation address, calendar, Listing information, Listing photos, and email address.

  • When you as a Guest invite additional Guests to a booking, your name, travel dates, Chef name, Listing details, Accommodation address, and other related information will be shared with each additional Guest.

4.3 Information You Publish in Profiles, Listings, and other Public Information.

You can make certain information publicly visible to others, such as:

  • Your public profile page, which includes your profile photo, first name (or initials where applicable), description, and city.

  • Listing pages that include information such as the Accommodation or Experience’s approximate or precise location description, calendar availability, profile photo, aggregated demand information (like page views over a period of time), and additional information you choose to share.

  • Reviews, ratings, and other public feedback.

  • Content in a community or discussion forum, blog, or social media post.

We may display parts of your public profile and other Content you make available to the public like Listing details on third-party sites, platforms, and apps.

Information you share publicly on the DineAtMine Platform may be indexed through third-party search engines. In some cases, you may opt-out of this feature in your account settings.

4.4 Chef Service Providers.

Chefs may use third-party services to help manage or deliver their services, such as cleaning services or lock providers. Chefs may use features on the DineAtMine Platform to share information about the Guest (like check-in and check-out dates, Guest name, Guest phone number) with such third-party service providers.

4.5 Complying with Law, Responding to Legal Requests, Preventing Harm and Protecting our Rights.

We may disclose your information to courts, law enforcement, governmental or public authorities, tax authorities, or authorized third parties, if and to the extent we are required or permitted to do so by law or where disclosure is reasonably necessary to: (i) comply with our legal obligations, (ii) comply with a valid legal request (such as a subpoena or court order) or to respond to claims asserted against DineAtMine, (iii) respond to a valid legal request relating to a criminal investigation to address alleged or suspected illegal activity, or to respond to or address any other activity that may expose us, you, or any other of our users to legal or regulatory liability (more information on DineAtMine’s Law Enforcement Guidelines here), (iv) enforce and administer our agreements with Members, including our Terms or (v) protect the rights, property or personal safety of DineAtMine, its employees, its Members, or members of the public. For example, if permitted due to the foregoing circumstances, Chef tax information may be shared with tax authorities or other governmental agencies.

Where appropriate, we may notify Members about legal requests unless: (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law, or (ii) we believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm to an individual or group, or create or increase a risk of fraud upon or harm to DineAtMine, our Members, or expose DineAtMine to a claim of obstruction of justice.

Where legally required or permissible according to applicable law, we may disclose Chefs’ and/or Guests’ information to tax authorities for the purpose of the tax authorities’ determination of proper compliance with relevant tax obligations. Relevant tax obligations include DineAtMine’s tax obligations on its service fees, its facilitation of taxes on accommodations and withholding taxes, and Chefs’ individual tax obligations. Information that may be disclosed includes, but is not limited to, Chef and Guest names, listing addresses, Chef addresses, tax/business identification number(s), date of birth, and/or contact information, property parcel identification numbers, payout information, transaction dates and amounts, number of nights and Guests booked, gross and net booking value and payout amounts, taxes collected by DineAtMine on behalf of Guests and Chefs, to the extent any of this information is known by DineAtMine.

In jurisdictions where DineAtMine facilitates or requires a registration, notification, permit, or license application or number of a Chef with a governmental authority, we may share information of participating Chefs with the relevant authority, both during the application process, when the Listing is published, and periodically thereafter, such as the Chef’s full name and contact details, Accommodation address, tax identification number, registration, permit, or license number, Listing details, reservation information, and number of nights booked subject to applicable laws.

4.6 Programs with Managers and Owners.

We may share personal information of Chefs and Guests with landlords, management companies, and/or property owners (“Building Management”), such as booking information and information related to compliance with applicable laws, in order to facilitate programs with Building Management. For example, guest booking and personal information, including guest contact information, may be shared with the Building Management of the building, complex, or community where a Chef lives and/or the listing is located to facilitate Chefing services, compliance with applicable laws, security, billing, and other services.

4.7 Chef Information Provided to DineAtMine for Work Customers.

If a booking is designated as being for a business or work purpose and (1) is made by a Guest affiliated with an Enterprise and (2) the Enterprise is enrolled in DineAtMine for Work, we may disclose information related to the booking to the Enterprise (e.g., name of the Chef, Accommodation address, booking dates, Listing details, etc.) to the extent necessary for the adequate performance of DineAtMine’s contract with the Enterprise and to provide the services. At the request of the Enterprise or the Guest, we may also share this information with third parties engaged by the Enterprise to provide support services.

4.8 Service Providers.

We share personal information with affiliated and unaffiliated service providers to help us run our business and for their compliance purposes, including service providers that help us: (i) verify your identity or authenticate your identification documents, (ii) check information against public databases, (iii) conduct background or police checks, fraud prevention and risk assessment, (iv) perform product development, maintenance and debugging, (v) allow the provision of the DineAtMine Services through third-party platforms and software tools (e.g. through the integration with our APIs), (vi) provide customer service, advertising, or payments services, or (vii) process, handle or assess insurance claims or similar claims. These providers are contractually bound to protect your personal information and have access to your personal information to perform these tasks.

4.9 Business Transfers.

If DineAtMine undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all of our assets, including your information in connection with such transaction or in contemplation of such transaction (e.g., due diligence). In this event, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.

4.10 Corporate Affiliates.

To support us in providing, integrating, promoting and improving the DineAtMine Platform, Payment Services, and our affiliates’ services, we may share personal information within our corporate family of companies that are related by common ownership or control. Some examples are:

  • Sharing with DineAtMine, Inc. Even if your country of residence is not the United States, your information will be shared with DineAtMine, Inc. which provides the technical infrastructure for the DineAtMine Platform.

  • Sharing with DineAtMine Payments. In order to facilitate payments on or through the DineAtMine Platform, certain information as described in the “Outside of the United States” section will be shared with the relevant DineAtMine Payments entity.

  • Sharing with DineAtMine UK. Even if your country of residence is outside EEA (e.g. United States, Japan, China) your information may be shared with DineAtMine UK which provides customer support and other business operation services to other DineAtMine entities and may be disclosed in line with section 4.5 above.

  • Sharing with DineAtMine GSL. Even if your country of residence is not Japan, your information may be shared with DineAtMine GSL which provides customer support and other business operation services to other DineAtMine entities.

  • Sharing with DineAtMine in China. Even if your country of residence is not China, information you provided will be shared with DineAtMine China in the following circumstances:

    • Public data. Information you share publicly on the DineAtMine Platform.

    • Creating a Listing. If you create a Listing in China, information shared includes: (i) your name, phone number, email address, nationality, and passport/ID details, (ii) (if you use a Chinese corporate entity for Chefing) entity name, incorporation address, phone number, unified social credit code (or business registration number), name of legal representative and person in charge, business scope, registered capital, expiry date, other details on the business license and industry permit), (iii) Chef operation data (e.g., type of e-commerce business, industry permit provided, type of Chef/listing, entity registration obligation, account/operation active status, revenue, attestations, or url links to any such information), (iv) information relating to the Listing (e.g., address, descriptions, photos), (v) booking and check-in/out information relating to the Listing, such as Guest details as set out below in Chef Services, dates, time, and payment amounts, and (vi) messages between you and prospective and confirmed Guests at the Listing.

    • Chef Services. If you inquire about or book a Chef Service located in China, information shared includes: (i) your name, phone number, and email address (ii) booking and check-in/out information, including city, dates, times, payment amount, listing address and publicly available data about your listing, (iii) messages between the Chef and you or other Guests on the same booking, and (iv) the names, nationalities, gender, date of birth, and passport/national ID details (including type of ID, ID number and expiry date) of any Guests.

    • Sending Messages. If you send a message to a Chef in relation to that Chef’s Listing in China, information shared includes your name, profile picture, and message content.

The data sharing described above is necessary for the performance of the contract between you and us to enable you to list or book Chef Services in China and connect with Members in China, and vice versa. Chinese government agencies require DineAtMine China to disclose Chef and listing information relating to China listings, and guest booking and check-in/out information relating to reservations in China. Similar to other hospitality or short term rental companies that do business in China, DineAtMine China will disclose your information above to Chinese government agencies without further notice to you. Your information may be further shared with service providers (including in China) to help run our business. Our service providers may also disclose your information where required by law.

5. OTHER IMPORTANT INFORMATION

5.1 Analyzing your Communications.

We may review, scan, or analyze your communications on the DineAtMine Platform for reasons outlined in the “How We Use Information We Collect” section of this policy, including fraud prevention, risk assessment, regulatory compliance, investigation, product development, research, analytics, enforcing our Terms of Service, and customer support purposes. For example, as part of our fraud prevention efforts, we scan and analyze messages to mask contact information and references to other sites. In some cases, we may also scan, review, or analyze messages to debug, improve, and expand product offerings. We use automated methods where reasonably possible. Occasionally we may need to manually review communications, such as for fraud investigations and customer support, or to assess and improve the functionality of these automated tools. We will not review, scan, or analyze your messaging communications to send third-party marketing messages to you and we will not sell reviews or analyses of these communications.

5.2 Linking Third-Party Accounts.

You can link your DineAtMine account with certain third-party services like social networks. Your contacts on these third-party services are referred to as “Friends.” When you direct the data sharing by creating this link:

  • some of the information provided to us from linking accounts may be published on your public profile,

  • your activities on the DineAtMine Platform may be displayed to your Friends on the DineAtMine Platform and/or that third-party service,

  • a link to your public profile on that third-party service may be included in your DineAtMine public profile,

  • other DineAtMine users may be able to see any Friends that you may have in common with them, or that you are a Friend of their Friend if applicable,

  • other DineAtMine users may be able to see any schools, hometowns, or other groups you have in common with them as listed on your linked social networking service,

  • information you provide to us from the linking of your accounts may be stored, processed, and transmitted for fraud prevention and risk assessment purposes, and

  • publication and display of information that you provide to the DineAtMine Platform through this linkage is subject to your settings and authorizations on the DineAtMine Platform and the third-party service.

5.3 Third-Party Partners & Integrations.

Parts of DineAtMine may link to third-party services, not owned or controlled by DineAtMine, such as Google Maps/Earth. Use of these services is subject to the privacy policies of those providers, such as Google Maps/Earth Additional Terms of UseGoogle Privacy Policy (see here for more information on how Google uses information). DineAtMine does not own or control these third parties and when you interact with them you are providing your information to them.

6. YOUR RIGHTS

You can exercise any of the rights described in this section consistent with applicable law. We may ask you to verify your identity and request before taking further action on your request.

If your country of residence is China

6.1 Managing Your Information.

You can access and update some of your personal information through your Account settings. If you connected your DineAtMine Account to a third-party service, like Facebook or Google, you can change your settings and unlink from that service in your Account settings. You are responsible for keeping your personal information up to date.

6.2 Data Access and Portability.

In some jurisdictions, applicable law may entitle you to request certain copies of your personal information or information about how we handle your personal information, request copies of personal information that you have provided to us in a structured, commonly used, and machine-readable format, and/or request that we transmit this information to another service provider (where technically feasible).

6.3 Data Erasure.

In some jurisdictions, you can request that your personal information be deleted. Please note that if you request deletion of your personal information, or if your account is suspended, terminated, or voluntarily closed:

  • We may retain your personal information as necessary for our legitimate business interests, such as prevention of money laundering, fraud detection and prevention, and enhancing safety. For example, if we suspend an DineAtMine Account for fraud or safety reasons, we may retain information from that DineAtMine Account to prevent that Member from opening a new DineAtMine Account in the future.

  • We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, DineAtMine and DineAtMine Payments may keep information for tax, legal reporting, and auditing obligations.

  • Information you have shared with others (e.g., Reviews, forum postings) will continue to be publicly visible on DineAtMine, even after your DineAtMine Account is canceled. However, attribution of such information to you will be removed. Some copies of your information (e.g., log records) will remain in our database, but are disassociated from personal identifiers.

  • Because we take measures to protect data from accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited period of time.

7. SECURITY

While no organization can guarantee perfect security, we are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unauthorized access, loss, destruction, or alteration.

8. CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time in accordance with applicable law. If we do so, we will post the revised Privacy Policy and update the “Last Updated” date at the top. In case of material changes, we will also provide you with notice of the modification by email at least thirty (30) days before the effective date. If you disagree with the revised Privacy Policy, you can cancel your Account. If you do not cancel your Account before the date the revised Privacy Policy becomes effective, your continued access to or use of the DineAtMine Platform will be subject to the revised Privacy Policy.

2. WHO CONTROLS MY PERSONAL INFORMATION

2.1 Controller

Where this Subpage mentions “DineAtMine,” “we,” “us,” or “our,” it refers to the DineAtMine company that is responsible for your information under this Privacy Policy (the “Controller”). The designated Controller is set out in Schedule 1.

2.2 Payments Controller

The Privacy Policy also applies to the Payment Services provided to you by DineAtMine Payments pursuant to the Payments Terms of Service (“Payments Terms”).

When using the Payment Services, you will also be providing your personal information to one or more DineAtMine Payments entities (the "Payments Controller" as outlined in Schedule 1), which will be responsible for your information related to the Payment Services, generally depending on your country of residence.

2.3 Changing Your Country of Residence

If you change your country of residence, the Controller and/or Payments Controller will be determined by your new country of residence as specified above, from the date on which your country of residence changes. To this end the Controller and/or Payments Controller that originally collected your personal information will need to transfer such personal information to the new applicable Controller and/or Payments Controller. The new Controller and/or Payment Controller will continue to process your personal information as described in the Privacy Policy and Subpage when applicable.

3.1 Information Necessary For Use of Payment Services

The Payments Controller needs to collect the following information necessary for the performance of the contract with you and to comply with applicable law (such as anti-money laundering regulations). Without it, you will not be able to use Payment Services.

  • Payment Information. When you use the Payment Services, the Payments Controller requires certain financial information (such as your bank account or credit card information) in order to process payments and comply with applicable law.

  • Identity Verification and Other Information. The Payments Controller may require identity verification information (such as images of your government issued ID document(s), passport, national ID card, tax ID, or driving license) or other authentication information (such as your date of birth, address, email address, or phone number) and other information in order to verify your identity, provide Payment Services to you, and comply with applicable law.

3.2 How the Payments Controller Uses Personal Information Collected

We may use personal information as a part of Payment Services to:

  • Enable or authorise third parties to use the Payment Services,

  • Detect and prevent money laundering, fraud, abuse, and security incidents,

  • Conduct security investigations and risk assessments,

  • Comply with legal obligations (such as anti-money laundering regulations),

  • Enforce the Payment Terms and other payment policies,

5. YOUR RIGHTS

You benefit from rights pursuant to applicable law. While some of these rights apply generally, certain rights apply only in certain limited cases. 5.1 Data Access and Portability

You have the right to request certain copies of your personal information held by us. In certain instances, you also have the right to request copies of personal information that you have provided to us in a structured, commonly used, and machine-readable format and/or request us to transmit this information to another service provider (where technically feasible).

5.2 Rectification

You have the right to ask us to correct inaccurate or incomplete personal information about you (and which you cannot update yourself within your DineAtMine account).

5.3 User Data erasure

We generally retain your personal information for as long as is necessary for the performance of the contract between you and us, to comply with our legal obligations, and as permitted by applicable law.

You have the right to ask us to delete your personal information, subject to certain limitations and restrictions. Please note that if you request the erasure of your personal information:

  • We may retain your personal information as necessary for our legitimate business interests, such as prevention of money laundering, fraud detection, and prevention and enhancing safety. For example, if we suspend an DineAtMine account for fraud or safety reasons, we may retain information from that DineAtMine account to prevent that Member from opening a new DineAtMine account in the future.

  • We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, DineAtMine and DineAtMine Payments may keep your information for tax, legal reporting and auditing obligations.

  • Information you have shared with others (e.g., Reviews, forum postings) will continue to be publicly visible on DineAtMine, even after your DineAtMine account is cancelled. However, attribution of such information to you will be removed.

5.4 Withdrawing Consent

If we are processing your personal information based on your consent you can withdraw your consent at any time by changing your account settings or by sending a communication to DineAtMine to terms@dineatmine.uk.com specifying which consent you are withdrawing. Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal.

5.5 Restriction of Processing

You have the right to limit the ways in which we use your personal information, in particular where (i) you contest the accuracy of your personal information, (ii) the processing is unlawful and you oppose the erasure of your personal information, (iii) we no longer need your personal information for the purposes of the processing, but you require the personal information for the establishment, exercise, or defence of legal claims, or (iv) you have objected to the processing pursuant to Section 5.6 (below) and pending the verification whether the legitimate grounds of DineAtMine override your own.

5.6 Objection to Processing

You have the right to object to the processing of your personal information based on grounds specific to your situation if such processing is for direct marketing or is for a purpose based on a legitimate interest or public interest. If you object to processing based on legitimate or public interests, we will no longer process your personal information for these purposes unless we have compelling legitimate grounds for such processing or where the processing is otherwise required for the establishment, exercise, or defence of legal claims.

Where your personal information is processed for direct marketing purposes, you may, at any time, ask DineAtMine to cease processing your data for these direct marketing purposes by sending an e-mail to terms@dineatmine.uk.com

5.7 Lodging Complaints

You have the right to lodge complaints about our data processing activities by filing a complaint with our Data Protection Team who can be reached by the “Contact Us” section above or with your local supervisory authority or our lead supervisory authority.

6. RETENTION

We retain personal information for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law. The criteria used to determine our retention periods include:

  • the length of time we have an ongoing relationship with you and provide DineAtMine to you (for example, for as long as you have an account with us or keep using DineAtMine),

  • whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); and/or

  • whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).

7. OPERATING GLOBALLY & INTERNATIONAL TRANSFERS

To facilitate our global operations, DineAtMine and DineAtMine Payments may transfer, store, and process your information within our family of companies, partners, and service providers based in Europe, Asia Pacific and North and South America. Laws in these countries may differ from the laws applicable to your country of residence. If DineAtMine UK is the Controller and your information is shared with corporate affiliates or third party service providers outside the EEA, we have (prior to sharing your information with such corporate affiliates or third party service providers) established the necessary means to ensure an adequate level of data protection. This may be an adequacy decision of the European Commission confirming an adequate level of data protection in the respective non-EEA country or an agreement on the basis of the EU Model Clauses (a set of clauses issued by the European Commission).
